Colorado Title, Repossession & DMV Notes

Colorado DMV: Colorado vehicle titles are handled through the Colorado Department of Revenue Division of Motor Vehicles and county motor vehicle offices. Colorado DMV states that private sale or transfer title work is completed at the county motor vehicle office with a properly endorsed title and other required documents.

Liens and ELT: Colorado DMV title guidance states that when a vehicle has a lien, the title may be mailed directly to the lienholder or kept electronically if the lienholder uses the Electronic Lien Title program. Lien releases and title handling should be verified before sale, release, or transfer.

Statement of Repossession: Colorado DMV provides DR 2393 Statement of Repossession. The current DR 2393 form states that it has been combined to include the former DR 2412 Statement of Repossession, DR 2004 Floor Plan Declaration, and DR 2417 Certificate of Extension of Chattel Mortgage.

Colorado Title Requirement: The DR 2393 Statement of Repossession notes that the lienholder must show on the Colorado title. The form includes lienholder information, agent name, lien date, lien amount, delinquent date, possession date, VIN, year, make, model, and body.

Dealer and Non-Dealer Transfer Notes: Colorado's DR 2393 instructions state that if the lienholder is a licensed Colorado dealer, the vehicle may be transferred using a Colorado Dealer's Bill of Sale. If the lienholder is not a licensed Colorado dealer, the lienholder must establish title in its name before transferring ownership.

Law Enforcement Notification: Colorado Revised Statutes Section 42-6-146 addresses repossession of a motor vehicle or off-highway vehicle and requires notification to a law enforcement agency after repossession, including information such as the owner, repossessor, and mortgagee, lienholder, or assignee.

Peaceful Repossession: Colorado Revised Statutes Section 4-9-609 allows a secured party after default to take possession of collateral and to proceed without judicial process if it proceeds without breach of the peace. The same section also includes special language for manufactured homes or trailer coaches used and occupied as a residence.

Repossessor Bonding Disclosure: Colorado law includes requirements involving repossessor bonding and disclosure. Section 4-9-629 states that a secured party or assignee contracting with a person to recover collateral after default must contract only with a person bonded for property damage to or conversion of collateral in the required amount, and that a repossessor must disclose bonded status to the secured creditor or assignee.

Redemption, Sale & Deficiency: Redemption rights, sale notice, commercial reasonableness, surplus, deficiency, personal property, and post-recovery title handling should be reviewed by the creditor or counsel. Requirements may differ for consumer vehicles, commercial collateral, equipment, RVs, boats, trailers, manufactured homes, off-highway vehicles, and out-of-state title situations.
