Arizona Title, Repossession & MVD Notes
Arizona MVD: Arizona title and vehicle matters are handled through the Arizona Department of Transportation Motor Vehicle Division. ADOT states that Arizona title information is stored electronically for many vehicles and that title transfers may require a Title and Registration Application, signed title or Title Transfer Bill of Sale, lien release when applicable, fees, and additional documents for special situations.
Repossession Affidavit: ADOT lists Repossession Affidavit 48-0902. ADOT describes the purpose of this form as allowing a lienholder to certify that a vehicle has been legally repossessed.
Arizona Administrative Code: Arizona Administrative Code R17-5-407 states that the Department shall not transfer title when ownership of a motor vehicle reverts to a lienholder by repossession unless listed conditions are met. Those conditions include that the motor vehicle is physically located in Arizona, a notice of lien is filed with the Department, and a completed affidavit from the lienholder is submitted stating that the vehicle was repossessed on default pursuant to the lien and applicable law.
Affidavit Details: Arizona's repossession rule lists information that must be included in the affidavit, including VIN, model year, make, registered owner's name, date of repossession, state where the vehicle is titled, lienholder company name, lienholder agent or representative, lienholder signature, and notary or Department agent signature.
Sale Without Retitling to Lienholder: Arizona Administrative Code R17-5-407 states that a lienholder may sell a repossessed motor vehicle without first transferring title into the lienholder's name by completing a Bill of Sale for submission to the Department. The Bill of Sale may be combined with the affidavit of repossession and must include required buyer, sale, lien, odometer, seller, and address information.
Proof of Ownership and Transfer: Arizona Administrative Code R17-5-407 states that a completed repossession affidavit as prescribed in that section is proof of ownership, right of possession, and right of transfer.
Peaceful Repossession: Arizona Revised Statutes 47-9609 allows a secured party after default to take possession of collateral and to proceed without judicial process if it proceeds without breach of the peace. The facts of the contract, debtor, location, collateral type, and applicable law still control the proper recovery path.
