Oregon's Deficiency Threshold and What It Means
Oregon has a deficiency rule that creditors should understand before deciding whether to pursue recovery. A deficiency suit is only permitted if the loss after sale exceeds $2,500 per party to the security agreement. If both a husband and wife are on the contract, that threshold doubles to $5,000. This means that on lower-balance accounts where the expected recovery at auction won't leave a significant shortfall, the math on pursuing a deficiency judgment may not work out. It does not affect whether to repossess -- it only affects the downstream deficiency decision.
Oregon also has an unusual transfer documentation requirement: you need a certified mail receipt proving the debtor was sent notice. This isn't a step we can skip or reconstruct after the fact, so we account for it on every Oregon assignment to keep your paperwork clean for title transfer.
