Idaho Title, Repossession & DMV Notes

Idaho DMV: Idaho vehicle titles and title-related forms are handled through the Idaho Transportation Department vehicle title division. Clients should verify current title, lien, ELT, and transfer requirements before sale or transfer of a recovered unit.

Affidavit of Repossession: Idaho Transportation Department provides Affidavit of Repossession Form ITD 3366. The form includes vehicle or hull identification information, title number, repossession date, owner of record, lienholder of record, purchaser information when applicable, odometer details, and lienholder certification.

Title in Lienholder Name: Idaho's repossession affidavit includes an option stating that there is no transfer and requesting issuance of title in the name of the lienholder of record. If a purchaser is named on the form, the lienholder may convey rights, title, and interest to the purchaser according to the form language.

Electronic Liens and Titles: Idaho has an Electronic Liens and Titles program for participating lienholders. Paperless title handling, lien release, and paper title requests may depend on whether the lienholder participates in Idaho ELT. Lenders should verify current ELT procedures before ordering documents or attempting transfer.

Old Idaho Requirement Summary: The old Idaho state requirement summary listed Idaho as a title state, with security interests shown on title held by the lienholder. It also listed repossession as allowed under UCC principles when completed without breach of peace, no statewide repo licensing requirement, and liquidation documents as title plus repossession affidavit.

Repossession Process: Peaceful repossession may be permitted when conducted lawfully and without breach of peace. The correct process depends on the contract, collateral, debtor status, consumer/commercial facts, title state, notices, and post-recovery sale requirements.

Redemption and Notice: The old Idaho requirement summary stated that a debtor may have a right to redeem any time before disposition by tendering the obligation and reasonable expenses, and that reasonable notice of sale is generally required to be given to the debtor and other secured creditors. Current legal requirements should be confirmed by the creditor or counsel.

Idaho Plates: The old summary stated that Idaho plates remain with the vehicle. Clients should verify current Idaho plate handling rules for the specific vehicle, title, sale, and transfer situation.
