Washington Repossession Regulations

Title Information: For Washington vehicle titles, liens, and repossession title documentation, contact the Washington State Department of Licensing. Washington also provides a repossession affidavit form used by lienholders for vehicle or vessel repossession documentation.

Washington Title State: Repossessor license and registration information should be confirmed with the Washington State Department of Licensing.

Washington Recording: A security interest may be perfected by title application showing the secured party as legal owner. The old Washington requirement summary stated that perfection may relate back to the date of signing if the application is made within the required department period; otherwise it may be perfected as of the date the title application is received.

Washington Recovery: Peaceful repossession may be permitted when conducted lawfully and without breach of peace.

Washington Redemption: Ten day repo redemption.

Washington Deficiency: The old requirement summary stated that a deficiency judgment may be taken after foreclosure if a chattel mortgage, while deficiencies may not be allowed under a conditional sales contract. Clients should confirm the correct process for the specific contract and collateral.
