Georgia Title, Repossession & DMV Notes

Georgia DOR Title Office: Repossessed vehicle title and tag matters in Georgia are handled through the Georgia Department of Revenue and county tag offices. Georgia DOR states that repossessed vehicle titles and tags can be obtained at the appropriate County Tag Office.

Required Georgia Title Documents: Georgia DOR lists a completed and signed Form MV-1 Title/Tag Application, original valid title or manufacturer's statement of origin, completed and signed Form T-16 Affidavit of Repossession, and the title fee as required items for repossessed vehicle titles and tags. If the repossessor is not recorded as the lienholder or security interest holder, a legible copy of the contract may also be required.

Form T-16 Affidavit of Repossession: Georgia's Form T-16 is used by a repossessor to certify that a motor vehicle has been repossessed because the vehicle owner failed to meet the obligation for settlement of a lien or security interest. The form includes owner information, lienholder or security interest holder information, vehicle information, date of repossession, certification, and notary acknowledgment.

Georgia Title Not Available: The T-16 instructions state that if a Georgia title is not available, the repossessor must generally obtain a Georgia title in their name first, unless an odometer disclosure exemption applies and there is already a Georgia title on record. Out-of-state title situations may require the title to be submitted or the repossessor to secure title first from the state where the vehicle is currently titled.

Repossession Affidavit Filing: Georgia Form T-16 instructions say the affidavit must be completed in its entirety, printed or typed legibly, and submitted with required documents and fees to the county tag office. The form also warns that corrections or alterations will void the affidavit.

Peaceful Repossession: Georgia Code Section 11-9-609 allows a secured party after default to take possession of collateral and to proceed without judicial process if it proceeds without breach of the peace. The correct recovery method still depends on the contract, collateral type, debtor situation, location, and current law.

Deficiency Notice: Georgia Code Section 10-1-36 addresses motor vehicles repossessed after default and deficiency claims. The statute states that to pursue a deficiency against the buyer, the seller or holder must forward notice within the stated timeframe, and the notice must advise the buyer of redemption rights and the right to demand a public sale. Creditors should confirm current requirements with counsel before sale or deficiency action.
